However, because of regional differences, we may not provide each of these services.<\/p>\n\n\n\n<p>Disclaimer: We do not make any claims that any pet-waste bags we use are \u201cbiodegradable\u201d or \u201cdegradable\u201d or \u201ccompostable\u201d or that they will break down in a landfill or other environment. Such bags do not meet the California ASTM D6400 standard for biodegradable plastic bags. <\/p>\n\n\n\n<p><strong>Pet Shuttle and Pet Sitting Services<\/strong><\/p>\n\n\n\n<p> If you select our Pet Shuttle service, we will pick up your dog in our climate-controlled shuttle and take him to and from daycare, grooming, veterinarians, boarding facilities, or elsewhere. We provide trained and knowledgeable field technicians who will treat your yard and pets like their own. If you are not satisfied with the Services performed by our field technicians, please notify us in writing within two (2) days of the date the Services were performed. After we review your written notice, we may attempt to re-perform the requested Services to gain your reasonable satisfaction. If you are not satisfied after our second attempt of the requested Services, we may, at our discretion, refund the cost of the Services. Refunds will be provided as a credit to the debit or credit card used at the time of purchase. However, if you have signed up for Services as part of a promotion, but you cancel the Services before the service term concludes, we will charge you the difference between the regular rate for Services and the promotional rate for Services during the applicable service term.<\/p>\n\n\n\n<p>6. <strong><u>Materials<\/u><\/strong><strong>. <\/strong>You irrevocably permit, authorize, grant, and license us, our affiliates, successors, and assigns, and the employees, officers, directors, and agents of each and all of them, the right to display, exhibit, transmit, broadcast, reproduce, record, photograph, digitize, modify, alter, edit, adapt, create derivative works, exploit, sell, rent, license, otherwise use, and permit others to use and license other to use your pet\u2019s\/pets\u2019 name(s), image, likeness, and appearance (\u201c<strong>NIL Rights<\/strong>\u201d), and all materials created by or on behalf of us that incorporate any of the foregoing (\u201c<strong>NIL<\/strong> <strong>Materials<\/strong>\u201d), in worldwide perpetuity in any medium or format whatsoever now existing or hereafter created on any platform and for any commercial and non-commercial purposes, including but not limited to advertising and promotional materials, graphics, logos or other collateral derived from the NIL Materials, news articles and press releases, training materials, instructional videos, and corporate presentations, internal communications and corporate use including employee handbooks, and in any other manner of media as we determine without further consent or compensation to you. <\/p>\n\n\n\n<p>You irrevocably transfer, assign, and otherwise convey to us all ownership and your entire right, title, and interest, if any, in and to the NIL Materials and all copyrights and intellectual property rights in the NIL Materials arising in any jurisdiction throughout the world in perpetuity, including all registration, renewal, and reversion rights, and the right to sue to enforce such copyrights against infringers. You further agree to take whatever action (including signing assignment or other documents) we request to evidence our ownership or to help us obtain intellectual property rights in the NIL Materials.<\/p>\n\n\n\n<p>You agree to release us from any and all claims and liability for damages for libel, slander, invasion of privacy, right of publicity or any other claim based upon NIL Rights and the use of the NIL Materials, and any blurring, distortion, or any other form of manipulation of the NIL Materials, whether intentional or otherwise. You waive your right to determine the manner and form in which the NIL Materials are used or to inspect\/approve the final product incorporating the NIL Materials. We have no obligation to create or use the NIL Materials or to exercise any rights given by this waiver. THIS AGREEMENT PROVIDES US WITH YOUR ABSOLUTE AND UNCONDITIONAL CONSENT, WAIVER, AND RELEASE OR LIABILITY, ALLOWING US TO PUBLICIZE AND COMMERCIALLY EXPLOIT THE NIL RIGHTS AND PRIVATE INFORMATION AS SET OUT ABOVE BY SIGNING UP FOR THE SERVICES. OUR SOLE AND ENTIRE MAXIMUM LIABILITY, AND YOUR SOLE AND EXCLUSIVE REMEDY, SHALL BE LIMITED TO THE ACTUAL AMOUNT PAID BY YOU FOR THE SERVICES WE HAVE PERFORMED WITHIN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE ACCRUAL OF THE FIRST CLAIM RELATED TO THE SERVICES.<\/strong><\/p>\n\n\n\n<p>The limitation of liability set forth above shall only apply to the extent permitted by law.<\/p>\n\n\n\n<p>9. <strong><span style=\"text-decoration: underline;\">Indemnity.<\/span>&nbsp;<\/strong>You are responsible for all medical expenses and damages resulting from an injury to any technician or care provider while providing Services to you. You agree to defend, indemnify, and hold harmless us, our affiliates, licensors, and service providers, and our and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys\u2019 fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, any death, injury, or damage to property. This provision will survive termination or expiration of these Terms and\/or our completion of the Services.<\/p>\n\n\n\n<p>10. <strong><u>Vaccinations<\/u>. <\/strong>You are responsible for ensuring that your pets are current on all core vaccinations including, but not limited to Rabies and Parvo-Virus vaccinations, and any vaccinations required by local regulations or advised by a licensed veterinarian. Upon request, you must provide accurate, complete, and up-to-date vaccination records. We reserve the right to deny you Services if proof of vaccination is not provided or if the submitted records are found to be inaccurate, outdated, or incomplete.<\/p>\n\n\n\n<p>11. <strong><span style=\"text-decoration: underline;\">Force Majeure.<\/span>&nbsp;<\/strong>We will not be liable or responsible to you, nor be deemed to have defaulted or breached these Terms, for any failure or delay in our performance under these Terms when and to the extent such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including, without limitation, acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest, national emergency, revolution, insurrection, epidemic, lockouts, strikes or other labor disputes (whether or not relating to our workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown or power outage.<\/p>\n\n\n\n<p>12. <strong><span style=\"text-decoration: underline;\">Governing Law and Jurisdiction.<\/span>&nbsp;<\/strong>All matters arising out of or relating to these Terms are governed by and construed in accordance with the internal laws of the State of Illinois without giving effect to any choice or conflict of law provision or rule (whether of the State of Illinois or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than those of the State of Illinois.<\/p>\n\n\n\n<p>13. <strong><span style=\"text-decoration: underline;\">Dispute Resolution and Binding Arbitration.<\/span><\/strong> YOU AND WE ARE AGREEING TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY, OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. The Federal Arbitration Act will govern the interpretation and enforcement of this section. <\/p>\n\n\n\n<p>The arbitrator will have exclusive authority to resolve any dispute relating to arbitrability and\/or enforceability of this arbitration provision, including any unconscionability challenge or any other challenge that the arbitration provision or the agreement is void, voidable, or otherwise invalid. The arbitrator will be empowered to grant whatever relief would be available in court under law or in equity. Together with the Pet Butler Terms of Service (the \u201cTerms\u201d) (which Terms are incorporated by reference herein), these Shuttle &amp; Sitting Terms form a binding agreement between you and [closest_franchise_name] (\u201cus,\u201d \u201cwe\u201d or \u201cour\u201d), and govern your use of the Shuttle &amp; Sitting Services. These Shuttle &amp; Sitting Terms apply to all the dogs owned by you, including any and all new pets that you obtain on or after the date Shuttle &amp; Sitting Services begin, at any and all locations you designate for Shuttle &amp; Sitting Services.<\/p>\n\n\n\n<p><span style=\"text-decoration: underline;\">Assumption of Risk:<\/span>&nbsp;You acknowledge that there is an inherent risk of injury, illness, disability, property damage, or death in any environment associated with the shuttling and\/or boarding of animals, including without limitation, risks associated with illness or injuries, injuries from fights, injuries from dog bites, and contagious diseases (including but not limited to kennel cough and influenza) even if your dog has been immunized. You acknowledge that these risks may result from or be compounded by the actions, omissions, or negligence of our employees or others, including negligent emergency response or rescue operations of our employees. You understand that we cannot guarantee that your dog will not be injured or become infected with illness arising out of the Shuttle &amp; Sitting Services. NOTWITHSTANDING THESE RISKS, YOU ACKNOWLEDGE THAT YOU ARE VOLUNTARILY ENGAGING US TO PROVIDE SHUTTLE &amp; SITTING SERVICES WITH KNOWLEDGE OF THE DANGERS INVOLVED. YOU HEREBY AGREE TO ACCEPT AND ASSUME ALL RISKS OF INJURY, ILLNESS, DISABILITY, DEATH, AND\/OR PROPERTY DAMAGE ARISING FROM THE SHUTTLE &amp; SITTING SERVICES, WHETHER CAUSED BY OUR ORDINARY NEGLIGENCE OR OTHERWISE.<\/p>\n\n\n\n<p><span style=\"text-decoration: underline;\">Release of Liability:<\/span>&nbsp;You hereby expressly waive and release any and all claims, now known or hereafter known, against us, and our officers, directors, employees, agents, affiliates, owners, successors, and assigns (collectively, \u201cReleasees\u201d), on account of injury, illness, disability, death, or property damage arising out of or attributable to the Shuttle &amp; Sitting Services, whether arising out of our ordinary negligence or of any Releasees or otherwise. We may charge such costs to your debit or credit card on file.
